I'm actually curious how this line in the Terms would play out.

It is legal to resell software in Europe, but does this clause void it? HostBill is the exclusive owner of the software and all copies of it, and we're just using it. Not trying to challenge it, just curious.

And just to emphasize, this would've come up eventually.

Is this a new entry due to him reading what we're saying here? Because I certainly didn't see that in the terms I agreed to when I bought my software. This scumbag is deplorable.

Well, since we're on the subject...

I'm willing to pay up to a hundred bucks for an owned, unbranded license. A hundred bucks for one that includes the lifetime of free support, less, say, $50 bucks for one of the more recent versions that only include annual subscription support.

The only reason I'm willing to pay that much for another copy is because I'm already a HostBill user. if I wasn't, I wouldn't even offer that much for a copy of the software.

Well seeing as everything is now premium and modular i'll sell my owned, unbranded license of which includes EVERY premium module.  Missing two of the "newest" order pages for $60,000!!!  Interested?  *wink*

I didn't see this post, so i wanted to comment.

As this TOS was likely written without a law degree, my best guess would be a judge would easily supersede it based on inaccuracies and operating under EU law.  They can try and word whatever they like in the TOS.  If it goes against EU Rules, those agreements under any EULA, TOS, TOU are null and void.  Unless a customer has maliciously purchased the software with the intent to pirate it, 99 times out of 100 a consumer will win if they are the victim of an uneducated business.

It's like stating in a TOS "Though renewal fee's are $45 /year we reserve the right to withdraw $700 per month without notice from your credit card".  Even though it's there, doesn't make it legal or binding.  This is why i've always suggested to my customers to ensure their agreements are well written within the law of their country and better yet to have a lawyer rubber stamp an agreement so you're within your rights.
